Terms of Service

These Terms of Service ("Terms") govern access to and use of VoiceBack, the hospitality software and related services offered by Gavel GmbH ("we", "us"), trading as VoiceBack, registered at Bessemerstr. 51, 12103 Berlin, Germany (HRB 235854 B, Amtsgericht Berlin; VAT ID DE349556261), represented by Marvin Musialek.

By using our website at https://getvoiceback.com, creating an account, or otherwise accessing the service, you agree to these Terms. If you are using VoiceBack on behalf of a company, you represent that you have authority to bind that organization.

VoiceBack provides tools for hospitality businesses to monitor and work with guest feedback and related signals (including integrations with third-party platforms where available). The exact features depend on your plan and product configuration.

We may update, add, or discontinue features with reasonable notice where practicable. The service is described on our website and in-product; it is not covered by separate third-party websites except where we link to them.

You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account.

The service is intended for businesses and users who are at least 18 years old. We do not knowingly offer the consumer-facing service to children, consistent with our Privacy Policy.

You agree not to:

• use the service unlawfully or in a way that infringes others' rights;
• probe, scrape, or overload our systems except as permitted by API documentation or our written consent;
• reverse engineer or circumvent security or access controls;
• upload malware or interfere with the integrity or performance of the service;
• use the service to send spam or misleading communications.

We may suspend access if we reasonably believe these rules are violated.

We and our licensors own VoiceBack, including software, branding, and documentation. Subject to these Terms and your subscription, we grant you a non-exclusive, non-transferable right to use the service for your internal business purposes.

You retain rights in content and data you submit. You grant us the licence reasonably needed to host, process, and display that content to provide the service. Feedback you give us may be used to improve VoiceBack without obligation to you.

VoiceBack may connect to review platforms, messaging, analytics, hosting, payment, or other third-party services. Those services are governed by their own terms and privacy notices. We are not responsible for third-party sites or services you access outside VoiceBack.

Paid plans, trials, taxes, and billing cycles are presented when you subscribe or order (including in checkout or order confirmations). Statutory rights—including any applicable right of withdrawal for consumers—remain unaffected where they apply.

Each party will treat the other's non-public business information that is marked confidential or reasonably understood to be confidential with appropriate care, and use it only for the purpose of the agreement.

Except where mandatory law provides otherwise, the service is provided "as is" and "as available". We do not guarantee specific business outcomes (for example, review scores or rankings on third-party platforms).

To the extent permitted by applicable law—particularly the laws of Germany—our liability is limited as follows: we are liable without limitation for intent (Vorsatz), gross negligence (grobe Fahrlässigkeit), injury to life, body or health, and under mandatory product liability rules.

In case of slight negligence (leichte Fahrlässigkeit), we are liable only for breach of a material contractual duty (Kardinalpflicht), and liability is limited to foreseeable, typical damage.

Subscriptions continue for the term you select and renew as shown at purchase unless cancelled in accordance with the process we provide in the product or order flow.

We may suspend or terminate access for material breach, non-payment where applicable, or legal requirements, with notice where required. After termination, your access ends; retention and deletion of data follow our Privacy Policy.

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms—where legally permissible—is Berlin, Germany.

As stated in our Imprint, we do not participate in consumer dispute resolution proceedings before a consumer arbitration board.

We may update these Terms by posting a new version on this page and updating the "Last updated" date. If changes are material, we will provide additional notice where required by law (for example by email or in-product message).
